Proposed Rule Change

Oregon Lottery is proposing a change to the rule regarding stolen, defective, damaged, or destroyed Scratch-it tickets.

Background 
Currently, Scratch-it ticket rules allow retailers to be credited or not billed for tickets under certain circumstances, such as theft or accidental destruction. However, the credit process is time consuming for Lottery and retailers and results in only a small number of credits being issued. For example, Lottery has issued only three credits for stolen tickets in the last year.

What’s Changing?  
The proposed change would clarify that retailers are financially responsible for tickets in their possession except in cases where tickets are defective or they are damaged during shipment, delivery, or dispensing. The rule also outlines updated reporting and return timelines. What Does This Mean for Me? 
The retailer is financially responsible for all tickets in their possession including tickets that are lost, stolen, damaged, or destroyed regardless of activation status:

  • The retailer must report lost or stolen tickets to Lottery in 48 hours.
  • The retailer will be charged for non-activated tickets when reported lost or stolen.
  • No partial credit will be issued for stolen tickets.

The retailer is not financially responsible for defective tickets or tickets damaged during shipment, delivery, or dispensing.
